Welcome to FLYHUB LLC ("Company", "we", "our", or "us"). By accessing our website, purchasing our services, or signing a Statement of Work (SOW), you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.

1. Scope of IT Services

FLYHUB LLC provides information technology services, including but not limited to software development, web design, IT consulting, cloud management, and technical support. The specific deliverables, milestones, and timelines for any project will be governed by a separate mutually signed Statement of Work (SOW) or Service Level Agreement (SLA).

2. Client Obligations and Access

To perform the services, you agree to provide FLYHUB LLC with timely access to necessary data, source code, hosting environments, server credentials, and digital assets. We are not responsible for project delays caused by a lack of client cooperation or delayed asset delivery.

3. Intellectual Property Rights

Upon full and final payment of all outstanding invoices, ownership of the custom deliverables, custom code, or designs created specifically for you will transfer to the client.
FLYHUB LLC retains all rights to its pre-existing code, proprietary tools, frameworks, and methodologies utilized during the project.

4. Limitation of Liability

In no event shall FLYHUB LLC be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data loss, server downtime, system breaches, or business interruption, arising out of the use or inability to use our technical services. Our total liability shall not exceed the amount paid by you for the specific service under dispute.

2. REFUND AND CANCELLATION POLICY

At FLYHUB LLC, we stand behind the quality of our IT services while maintaining clear financial guidelines for professional service allocations.

1. Milestone and Hourly Payments

Setup Fees and Deposits: All upfront project deposits, onboarding fees, or discovery phase fees are strictly non-refundable as they secure engineering and consulting resources.
Milestone Payments: Projects divided into developmental phases or milestones are non-refundable once the phase work begins. Acceptance and sign-off on a milestone constitute final approval of that work portion.
Hourly Services: Hourly technical support, custom troubleshooting, and ad-hoc consulting hours are billed based on time worked and are non-refundable.

2. Subscription and Retainer Cancellations

For ongoing monthly IT support, managed hosting, or software-as-a-service (SaaS) retainers, you may cancel your subscription at any time.
To avoid being billed for the next cycle, cancellation requests must be submitted in writing at least 14 days prior to your next scheduled billing date.
No pro-rated refunds will be issued for partial months or unused retainer hours remaining in a billing cycle.

3. Project Termination

Either party may terminate a project contract by providing written notice as specified in your individual SOW. Upon termination, the client will be invoiced for all hours logged and work completed up to the effective date of termination, and any outstanding balance must be settled immediately.
